Marriage Registration in Poland for Foreigners 2026

Marriage registration in Poland for foreigners 2026: required documents, the 1-month wait, sworn translations and what it changes for residence. Ask us on WhatsApp.

You've found someone. You both live in Poland, or one of you is about to. You walk into the civil registry office, hand over your passport, and the clerk says: "Where is the certificate of legal capacity?" Your partner looks at you. You look at the floor.

This happens every week. Marriage registration in Poland for foreigners in 2026 is not complicated, but it is document-heavy, and the documents come from your home country. Nobody warns you about that part. So here is the honest picture: what the office asks for, what takes time, and what a marriage does and does not change for your residence.

What does the registry office actually require from a foreigner?

Short answer: more than a passport. Marriage in Poland is handled by the Urząd Stanu Cywilnego (USC), the civil registry office, under the Family and Guardianship Code and the Civil Status Records Act. The office must confirm who you are, your marital status, and that nothing legally blocks the marriage.

The core file for a foreigner usually looks like this (always confirm the exact list with the USC where you will marry, because offices ask for slightly different extras). Official overview: gov.pl — Weź ślub cywilny.

  1. A valid passport (or other identity document) for each partner.
  2. A birth certificate for each partner. For a foreign birth certificate you will normally need a sworn translation into Polish, and depending on the country an apostille or consular legalisation.
  3. The certificate of legal capacity to marry (in practice called zaświadczenie o zdolności prawnej do zawarcia małżeństwa). This is a document from the authorities of your country, or from its embassy or consulate, confirming that under your national law you are free to marry.
  4. If you were married before: proof that the earlier marriage ended, such as a divorce judgment with a final-and-binding stamp, or a death certificate of the former spouse. These also need translation.
  5. The application and written statements on the form the USC gives you, including the statement that you know of no circumstance that prevents the marriage.

Every foreign-language paper must reach the office with a Polish translation by a sworn translator (tłumacz przysięgły). A plain Google translation or a friend's help will be refused.

What if my country doesn't issue a certificate of legal capacity?

This is the single biggest blocker, and it is exactly where couples lose weeks. Some countries simply do not issue such a document. Others issue it slowly, or only in the home country.

The law has an exit. If you cannot obtain the certificate, you can apply to the Polish district court (sąd rejonowy) for an exemption from the duty to present it. The court decides on your application and, if it agrees, the USC accepts the court decision instead. A useful practical summary of the foreigner route is on the Instytut na Rzecz Państwa Prawa site. We are not a court and cannot promise the outcome, but we prepare the application and the supporting papers so it is not rejected for form errors.

One more point many couples miss: Polish law recognises marriage between a woman and a man. If your plan is something else, the USC will not register it, and it is better to know that before you pay for translations.

How long is the waiting period before the ceremony?

There is a statutory waiting period. A marriage can be concluded once one month has passed from the day you submit the statements to the USC. For important reasons, the head of the USC can shorten that time, and the shortening is a separate decision with its own stamp duty. The official stamp duty for the marriage certificate is 84 PLN; check the current list on gov.pl or your USC before paying, since local rules for extras (for example a ceremony outside the office) differ.

Notice what the one month starts from: the day your file is complete and accepted, not the day you first visit. If your capacity certificate or court exemption is still missing, the clock has not started. That is why the document stage, not the month, usually decides how long the whole thing takes. We don't promise dates. Offices, countries and courts all move at different speeds.

If one of you does not speak Polish well enough, the ceremony itself needs a sworn translator present. Book that early; a wedding date lost to a missing interpreter hurts.

Step by step: from first visit to the Polish marriage certificate

Here is the order that works in practice:

  1. Check your legal stay is in order and note when your passport, visa or karta pobytu expires.
  2. Ask the USC for its current document list for foreigners. Do this before ordering anything abroad.
  3. Order the birth certificate and the capacity certificate (or start the court exemption route if the certificate cannot be obtained).
  4. Add apostille or legalisation where your country requires it, then order sworn translations of everything.
  5. Submit the application and statements at the USC; the waiting period is counted from here.
  6. Choose the ceremony date and arrange the sworn translator if needed.
  7. Marry. Witnesses are not mandatory in a civil ceremony, but the office will tell you its practice.
  8. Receive the marriage certificate (odpis aktu małżeństwa). Get several copies; you will use them for almost everything later.

Aarav is a software tester from Pune, and Marta is a Polish teacher. They assumed love plus passports was enough. The USC asked for his capacity document and sworn translations of his birth certificate. Nothing was wrong with their relationship, but their file was incomplete, and the month had not even begun. It's an illustrative composite, not a real client, and it is the most common story we see.

Practical tip: before you order any paper from your home country, ask the USC in writing which documents it wants, in which form, and how old they may be. Some certificates expire for the office after a few months.

Does marriage change your karta pobytu? What it does and does not do

Let's be direct, because this is the question underneath all the others.

Marriage is not a shortcut to residence. A registered marriage does not automatically give you the right to stay in Poland. It can open a separate legal route, for example a temporary residence permit for family reasons if your spouse is a Polish citizen, or the family reunification route if your spouse holds a residence permit in Poland. That route requires its own application, its own documents and its own decision.

And offices look at the substance. Authorities in Poland verify whether the marriage is genuine — shared life, shared address, real contact. A marriage concluded only to obtain a permit leads to refusal and can bring legal consequences for everyone involved. We only help real couples. If you're still learning how family routes work, start with our guides: bringing your family to Poland (Nepal citizens) and for Philippines citizens. For the long-term picture, see the real 5-year path to permanent residence.

Also, do not let your current permit lapse while you plan a wedding. If you already have a karta pobytu or an application pending, marriage changes your family situation, not the deadlines of your case. Official information for foreigners lives on gov.pl/web/cudzoziemcy.

What do we do, and what do you do?

Legal Solutions organises the official registration of marriage at a Polish civil registry office for foreigners, ending with the Polish marriage certificate (odpis aktu małżeństwa). To start, you give us only your passport details. We prepare the file, obtain the required certificates and zaświadczenia and translations, organise the procedure, and accompany you at every stage.

The law still requires several documents. We simply carry that weight, so you don't spend your evenings translating bureaucracy. We are not a court and not a substitute for the USC's decision, and we never promise a date or a result.

Frequently Asked Questions

Is a passport enough to get married in Poland?

No. The passport proves identity, but the USC also needs your birth certificate, your capacity certificate (or a court exemption), proof that earlier marriages ended, and sworn translations. The point is that you only need to give us the passport details to begin; we collect and prepare the rest.

Can I marry in Poland if my country doesn't issue the capacity certificate?

Often yes. You can apply to the district court for an exemption from presenting it. The court decides, and the USC then accepts that decision. Whether the court agrees depends on your case, so nobody can guarantee it.

Will I get a karta pobytu automatically after marrying a Pole?

No. Marriage can open a family-based residence route, but you must file a separate application, and the office checks that the marriage is genuine. Nothing is automatic.

Do I need a sworn translator at the wedding?

If one partner doesn't speak Polish well enough, yes — the ceremony requires an interpreter, and sworn translations are required for foreign documents anyway. Arrange it before you set the date.

Can the one-month waiting period be shortened?

For important reasons the head of the USC can shorten it, with a separate decision and fee. It is a decision of the office, not your right, so don't book travel or guests until it's confirmed.
