No. Marrying a Polish citizen does not automatically give you the right to live in Poland. It gives you the right to apply for a residence permit on a family basis. Does marrying a Polish citizen give you residency automatically?

No. Your marriage is the reason for the permit, not the permit itself. You still need a temporary residence permit (zezwolenie na pobyt czasowy), and in the end you get a residence card, the Karta Pobytu (Polish residence permit card).

The good news: the spouse route is lighter than a work permit route. According to the official guidance, a spouse of a Polish citizen does not have to show stable regular income, health insurance or a guaranteed place of residence for this permit. The authorities mainly want to know that your marriage is real, valid in Poland, and actually lived.

What is the filing deadline for a spouse residence permit?

This is the point where people lose the most. Per the official procedure, you submit the application no later than on the last day of your legal stay, if you plan to stay longer than 3 months. Not after the wedding party. Not when you "get around to it".

Applications are filed electronically through MOS, the case-handling portal, and you log in with Profil Zaufany. Details are on the official MOS information pages and at gov.pl/web/cudzoziemcy. Please check the current form of the procedure before you file, because rules for online filing changed in 2026.

Your checklist before you file:

  1. Get your marriage certificate registered or recognised in Poland if the wedding took place abroad (a Polish translation and the right registration are needed).
  2. Set up Profil Zaufany so you can log in to MOS.
  3. Prepare your passport, a photo and the proof of payment.
  4. Pay two separate fees to two separate accounts (see below).
  5. Submit in MOS before your legal stay ends and keep the confirmation.

How much does a temporary residence permit for a spouse cost?

According to the official fee information, you pay PLN 340 stamp duty for granting the temporary residence permit and PLN 100 for issuing the residence card. These are two payments. If proof of the stamp duty is missing, the application can be returned.

The permit is granted for up to 3 years. Plan the next step early: a renewal, or later a permanent residence permit.

What will immigration authorities check about your marriage?

They check whether the marriage is genuine. A permit is refused if the marriage was entered into to get around the rules on entry and stay of foreigners, the so-called fictitious marriage. This is a legal test, not an insult, and real couples pass it with ordinary evidence.

What helps a real couple:

A fictitious marriage has heavier consequences than a refusal, including the risk of an entry ban in the system. Never agree to a "paper marriage", however it is offered.

What happens to your residence permit if you divorce?

Divorce is the point the wedding day never mentions. A permit based on marriage depends on the marriage. If the marriage ends, your basis for staying can disappear and the permit can be affected.

The law has a narrow exception. If you apply after divorce or separation, you need to show an important interest that justifies a permit. Such a permit can be granted once, for up to 3 years. This is not automatic and it is not guaranteed, so do not plan around it.

Two practical rules. First, do not wait for the relationship to end before you learn your options: a job-based or other basis may exist. Second, if there are children, the next section matters a lot.

Practical tip: Put the date your legal stay ends in your phone calendar the day you marry, with a reminder 60 days earlier. Filing late is the one mistake no later document can fix.

Can a child who is a Polish citizen give you another residence path?

Yes. A parent of a minor child who is a Polish citizen can apply for a temporary residence permit as a family member of a Polish citizen. The authorities look at whether your ties with the child are real and lasting.

Per the official information, the stamp duty is PLN 340 and the residence card fee is PLN 100, or PLN 50 for a child under 16. The permit is granted for up to 3 years.

Typical documents include a copy of the child's ID or passport (or other proof of Polish citizenship), the child's birth certificate and health insurance. This route works separately from the marriage, which is why it matters in case of divorce. Your relationship with the child, not with the spouse, becomes the basis.

When can you apply for permanent residence as a spouse?

The rule says: you must have been married to the Polish citizen for at least 3 years before filing, and directly before filing you must have lived in Poland without a break for at least 2 years on a temporary permit granted because of that marriage (or on certain protection-based statuses). The fee is PLN 640 for the permit and PLN 100 for the card.

From 27 April 2026, a permanent residence application is filed only online through MOS. Check the current requirements before you submit, and keep your temporary permit continuous. A gap can break the 2-year count.
