Marrying a Foreigner in Poland 2026: No Consulate Certificate, 1 Court Ruling, 1-Month Wait

Marrying a Foreigner in Poland 2026: Documents & Way Out

Marrying a foreigner in Poland feels impossible when the consulate won't issue papers. Here are the documents, the court route and the 1-month wait. Message us.

It's a Tuesday, 9:40 a.m. You're standing in the civil registry office (USC) with your partner, who has been waiting eight months for his karta pobytu (Polish residence card). The clerk says calmly: “We need a certificate from his country saying he is free to marry.” He can't go and fetch it: there's a stamp in his passport, his visa expired long ago. The consulate emails back that it doesn't issue such documents. Suddenly, marrying a foreigner in Poland looks like a locked door.

You're not alone. The pattern repeats every week among Polish women preparing a case for a foreign husband. The good news: it's usually not a dead end. The law has a way around the missing paper. Here is what it really requires, where couples get stuck, and what you can do as the Polish partner.

Why does marrying a foreigner in Poland feel impossible?

Because each person's ability to marry is judged under their own national law. Your partner must show that, under the law of his country, nothing prevents the marriage, for example that he isn't already married. This is normally confirmed by a certificate issued by an authority of his country, or by its embassy or consulate in Poland.

The trouble starts when that document is hard to get. These are the situations we see weekly:

People hear “no paper, no wedding” and give up. That is not the full answer.

USC paperwork: a wedding with a foreigner in Poland starts with a complete file, not a ceremony hall

Which documents does the USC really require from a foreigner?

There is no “passport only” rule. Polish civil-status law requires several documents from a foreign partner. Individual offices may ask for small additions, so always confirm with the USC you'll use.

On the Polish side you add your own documents and joint declarations made at the office. The legal basis is the Family and Guardianship Code and the Act on Civil Status Records. General information for foreigners is on gov.pl/cudzoziemcy.

What if the consulate won't issue the certificate? The court route

This is the way out many couples don't know about. A district court can release a foreigner from the duty to present the certificate from his country. It applies, among others, when that state doesn't issue such certificates, or when for political reasons the person fears approaching its authorities (especially if he is also seeking refugee status). The exemption is granted on application, and the court decides each case on its own facts. Nobody honest can promise you the outcome.

The usual order is:

  1. Check whether the consulate truly won't issue the certificate (ideally get a refusal or written statement).
  2. Prepare an application to the district court with documents showing why the certificate can't be obtained.
  3. Once you have the ruling, file it at the USC together with the remaining documents and the sworn translations where needed.
  4. Set the wedding date.
A district court ruling can replace the certificate the consulate refuses to issue

We explain this route in more detail here: marrying in Poland without a certificate of no impediment. For the general picture see marriage registration in Poland for foreigners.

How long is the wait before the wedding, and can it be shortened?

A marriage can be concluded after one month from the day the documents are filed at the USC. In special circumstances the head of the USC may shorten that month. It's their decision, not a couple's right, so don't book the venue assuming it will be cut. Documents filed at the USC also stay valid for a limited time (check the exact period with your office), so don't file them “just in case”.

Plan the order: first find out whether the certificate can be obtained; if not, go straight to the court route. The most common mistake is months lost waiting for a consulate.

What does marriage change for a residence card, and what doesn't it change?

Let's be plain: marriage is not a shortcut to residence in Poland. Offices check whether the marriage is genuine, and a marriage concluded only to obtain a permit leads to refusal and serious legal consequences. We only help real couples.

What changes for a genuine couple? You hold a Polish marriage certificate and can apply for a temporary residence permit as the spouse of a Polish citizen. Official sources list a PLN 340 stamp duty plus PLN 100 for issuing the card, and the permit is granted for up to 3 years. Always check current fees with your voivodeship office.

What it doesn't change: it doesn't repair gaps in legal stay, replace deadlines or guarantee a decision. If your husband's visa is running out or his legal stay is ending, you must act in parallel.

Signing at the USC is the start, not the end: the residence card is a separate procedure

For the next step read the residence permit for a foreign husband and 5 things the wedding doesn't fix.

An illustrative example (a composite story, not a real client): Marta from Gdańsk and her fiancé, an IT specialist from South Asia, spent four months waiting for a certificate from his consulate. When it turned out such documents aren't issued there, they prepared a court application, and once they had the ruling they filed the full set at the USC. The wedding still took place only after the statutory wait, but without months more in the waiting room.

Practical tip: keep proof that the certificate can't be obtained: the consulate's refusal, emails, dates of your requests. Without it the court application is weaker and you lose time explaining yourself.

How does Legal Solutions handle a wedding with a foreigner?

We organize the official registration of the marriage at a Polish civil registry office (Urząd Stanu Cywilnego) for foreigners, ending with a Polish marriage certificate (odpis aktu małżeństwa). The law requires several documents, but the couple doesn't have to collect them alone. To start we only need passport details. We prepare the documents, obtain the required certificates and translations, organize the procedure and accompany you at every stage. If the court route is needed, we help you through it.

We help, prepare and accompany. We are not acting as an advocate or legal adviser (adwokat or radca prawny) and we don't promise any outcome in court or at an office.

Frequently Asked Questions

Can I marry a foreigner who doesn't have a karta pobytu yet?

The rules on concluding a marriage focus on identity and civil status; residence status is a separate matter. In practice, though, his residence situation affects what comes next, so discuss it with us before filing at the USC.

Will the court always exempt him from the consulate certificate?

No. The court reviews each application individually. An exemption is realistic when his state doesn't issue such certificates or there are serious reasons not to approach its authorities. That's why proof of your attempts matters.

Does marriage automatically give my husband a residence card?

No. The wedding is one procedure, the karta pobytu is another. The voivodeship office also checks that the marriage is genuine, and nobody can guarantee a decision.

How long do we really wait before the wedding at the USC?

As a rule, one month from filing the documents. In special cases the head of the USC may shorten it, but that is discretionary. The longer part is usually collecting the documents, not the waiting period itself.
